By accessing, browsing, or placing an order on BikeGuard Collective (“the Site”), you (“the Customer”) acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable EU laws (including the Consumer Rights Directive) . If you do not agree, you may not use the Site.

2. Definitions

  • “Trader”: BikeGuard Collective, the operator of the Site.
  • “Goods”: Motorcycle riding gear (helmets, jackets, armor, etc.) sold on the Site.
  • “COD”: Cash on Delivery, the sole payment method supported by the Site.
  • “Cooling-Off Period”: The 14-day period guaranteed by EU law for order cancellation .

3. Order Placement & Confirmation

3.1 You may place orders by selecting Goods, providing accurate delivery details (name, address, phone number), and confirming the order.

3.2 The Trader will send an order confirmation email within 24 hours, but this does not constitute a binding contract—contract formation occurs only when the courier delivers the Goods .

3.3 The Trader reserves the right to cancel orders due to stock shortages, pricing errors, or invalid delivery information, with prompt notification to you .

4. Cash on Delivery (COD) Terms

4.1 Payment Method: Only cash payments (in USD or local equivalent) are accepted upon delivery—card payments are not supported for COD .

4.2 acceptance & Payment: You must inspect the Goods at delivery before paying the courier. Payment confirms your acceptance of the Goods’ condition and compliance with your order .

4.3 Refusal of Payment: If you refuse to pay for non-defective Goods, you will bear the round-trip shipping costs (€15–€30, depending on location) .

4.4 COD Eligibility: COD is available only for delivery addresses in supported regions (check eligibility at checkout) .

5. Goods & Delivery

5.1 Quality & Compliance: All Goods meet EU safety standards (DOT/ECE for helmets, CE for armor) and are described truthfully on the Site .

5.2 Delivery: Orders ship within 2–3 business days; delivery takes 5–10 business days. Tracking links are provided via email .

5.3 Risk Transfer: Risk of damage or loss passes to you once the Goods are delivered (confirmed by courier tracking) .

5.4 Import Duties: For cross-border deliveries, you are solely responsible for customs duties, taxes, or fees imposed by your country .

6. Inspection & Returns

6.1 Cooling-Off Period: You may cancel or return Goods within 14 days of delivery, no reason required—provided Goods are unused, in original packaging, and with tags intact .

6.2 Defective Goods: Report defects (e.g., manufacturing flaws) within 7 days of delivery with photos. The Trader will arrange free returns and provide a refund or replacement .

6.3 Return Process: Contact grualccuy@gmail.com to request a return authorization. Return shipping is free for defective Goods; you pay for non-defective returns .

6.4 Refunds: Refunds for COD orders are processed via bank transfer within 7–10 business days of receiving returned Goods .

7. Privacy & Data Protection

7.1 The Trader collects only necessary data (name, address, phone number) to process orders and deliver Goods .

7.2 All data is encrypted, stored securely, and never shared with third parties except courier partners (for delivery purposes) .

7.3 You may request access, correction, or deletion of your data by contacting our support team .

8. Limitation of Liability

8.1 The Trader is not liable for delays caused by force majeure (e.g., weather, customs delays) or incorrect delivery details provided by you .

8.2 The Trader shall not be liable for damages arising from improper use of Goods (e.g., ignoring safety instructions for helmets/armor) .

8.3 Total liability for any claim shall not exceed the total value of your order .

9. Modifications to Terms

The Trader may update these Terms to comply with new EU regulations or business changes. Updates will be posted on the Site, and continued use constitutes acceptance of revised terms .
